The information in question relates to the fact that the aforementioned members of the Management Board of PKP Cargo implemented the PM's Decisions of 25 July and 6 October 2022 on the transport of coal without a proper legal basis and without adequately protecting the Company's interests, which resulted in material damage to the property of PKP Cargo, loss of significant income and expected benefits on the part of the Company.
"An examination of the collected information leads to the conclusion that PKP CARGO S.A. implemented the so-called coal decisions without due diligence in terms of verification of the legal basis for the action and without due protection of the material interests of PKP Cargo, for which the then collegiate Management Board of PKP Cargo was responsible. The way in which the decisions in question were implemented also caused material damage to the Company on a large scale. Therefore, it is absolutely necessary for the current Management Board of the Company to submit a report to the Public Prosecutor's Office - this is an obligation resulting from the provisions of the law" said Marcin Wojewódka, Acting President of the Management Board.
At the same time, the notifying parties also submitted for the consideration of the public prosecutor the question of the responsibility of former Prime Minister Mateusz Morawiecki as the author of the above-mentioned decisions and of former Minister of State Property Jacek Sasin - as public officials who, in the opinion of the notifying parties, exceeded their powers in issuing and implementing the above-mentioned decisions. In addition, they may have acted to the detriment of the public interest, thus fulfilling the disposition of abuse of authority by a public official (as alleged).
